ACCEPTANCE OF TERMS

Welcome to www.Lowcostlanyards.com (“Low Cost Lanyards”, “Site”, or “Website”) which is owned by ReThink Promotional Products, Inc. This Terms of Service Agreement ("Terms of Service", “TOS”, or "Agreement") contains the terms and conditions applicable to your access and use of Lowcostlanyards.com and Lowcostlanyards.com services ("Services"). By viewing, accessing and using Lowcostlanyards.com, you accept and agree to be bound by the terms and provision of this TOS. Low Cost Lanyards reserves the right to modify or amend this Agreement without notice at any time. It is therefore important that you read this page regularly to ensure you are updated as to any changes. All Users agree to: (a) provide true, accurate, current and complete information about yourself or the company you represent. If you provide any information that is untrue, inaccurate, not current or incomplete, or Low Cost Lanyards has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Low Cost Lanyards has the right to suspend or terminate Content and refuse any and all current or future use at Lowcostlanyards.com.

USER ACCOUNT AND PASSWORD SECURITY

You agree that any Content whatsoever submitted by you becomes the property of Low Cost Lanyards and may be used, copied, sublicensed, adapted, edited, transmitted, distributed, publicly performed, published, displayed or deleted as Low Cost Lanyards sees fit. You agree to release Low Cost Lanyards, its parents and affiliates together with their respective employees, agents, officers, directors and shareholders, from any and all liability and obligations whatsoever in connection with or arising from your use of the Site. If at any time you are not happy with the Site or object to any material or User Content on the Site, your sole remedy is to cease using it.

INDEMNITY

YOU AGREE TO INDEMNIFY, DEFEND AND HOLD Low Cost Lanyards, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, CO-BRANDERS, AND OTHER PARTNERS AND EMPLOYEES, HARMLESS FROM ANY LOSS, LIABILITY, CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF (a) USER CONTENT YOU SUBMIT, POST TO, OR TRANSMIT THROUGH THE WEBSITE; (b) YOUR USE OF THE WEBSITE OR THE SERVICES; OR (c) YOUR VIOLATION OF THIS AGREEMENT, ANY APPLICABLE LAWS, OR THE RIGHTS OF ANY THIRD PARTY.

MODIFICATIONS TO SITE

Low Cost Lanyards reserves the right at any time to modify or discontinue, temporarily or permanently, the Website or Services, or any portion thereof, with or without notice. You agree that Low Cost Lanyards shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Website.

SUSPENSION AND/OR TERMINATION OF RIGHTS

Low Cost Lanyards reserves the right, at its sole discretion, immediately and without notice, to suspend or terminate the Agreement, your ability to access or post to the Website, your ability to utilize any Services and/or to remove any User Content, for any reason, including without limitation any breach by you of the TOS or conduct by you that Low Cost Lanyards determines in its sole and absolute discretion to be inappropriate. You agree that Low Cost Lanyards shall not be liable to you or any third-party for any such suspension or termination.

CONTACT WITH ADVERTISERS

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through Lowcostlanyards.com, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Low Cost Lanyards DISCLAIMS ALL LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND FURTHER DISCLAIMS ALL LOSSES, INCLUDING WITHOUT LIMITATION INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH ACCESS TO OR USE OF THE WEBSITE OR THE SERVICES, EVEN IF Low Cost Lanyards HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, Low Cost Lanyards AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT AND YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO Low Cost Lanyards DURING THE SIX (6) MONTHS PRIOR TO THE DATE THE APPLICABLE CAUSE OF ACTION AROSE.

IN THE CASE OF REFUNDS RESULTING FROM LOWCOSTLANYARDS ERROR (SUCH AS INABILITY TO MEET RUSH PRODUTION AFTER ORDER CONFIRMATION), LOWCOSTLANYARDS WILL BE RESPONSIBLE FOR THE COST OF THE APPLICABLE ORDER. REFUND AMOUNT SHALL NOT EXCEED THE TOTAL AMOUNT OF THE ORDER.

EXCLUSIONS AND LIMITATIONS

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
